Agreement to these terms

These Terms of Use (“Terms”) are an agreement between you and NYsweets LLC (“Sweet's,” “we,” “us”). They govern your use of sweetsny.com and ny-sweets.com and any page that links to these Terms (together, the “Site”), and any merchandise you buy from us. By using the Site you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Site.

Eligibility: 21+ only

The Site is intended only for adults 21 years of age or older. By entering the Site you confirm that you are at least 21. If you are under 21, you may not use the Site, sign up for our emails or buy our merchandise. We may block access or cancel orders if we believe these requirements aren’t met.

No online sales of cannabis

Sweet's cannabis products are sold only through New York State licensed adult-use dispensaries. We do not sell or ship cannabis online.

Nothing on the Site is an offer to sell cannabis. We don’t accept orders, reservations, payments or delivery requests for cannabis products. Dispensaries listed on the Site are independent licensed businesses — their menus, prices, hours, availability and policies are their own, and dispensary information on the Site may change without notice. Please confirm details with the dispensary directly.

Product information

• Lab data varies by batch. Cannabinoid and terpene figures on the Site are examples or ranges from past batches. The label on your package and its certificate of analysis (COA) are the controlling source for that product.
• Information only. Content on the Site is provided for adults for general informational purposes. It is not medical advice, and we make no health or therapeutic claims about any product.
• Images are illustrative. Packaging renders, artwork and photos may differ from the product you find in stores.

Cannabis & the law

Adult-use cannabis is legal in New York State for adults 21 and older under the Marihuana Regulation and Taxation Act and its regulations. It remains illegal under federal law. Don’t take cannabis across state lines, don’t consume it where use is prohibited, and keep it locked up and out of reach of children and pets.

Cannabis can impair concentration, coordination and judgment. Do not operate a vehicle or machinery under the influence of cannabis.

Merch purchases

Merchandise (apparel and accessories) is the only thing sold on the Site. It contains no cannabis. These store terms apply to merch orders:

• Seller & checkout. Merch is sold by NYsweets LLC. Checkout and payment are handled by our third-party e-commerce and payment providers, whose terms also apply to the checkout process.
• Prices & availability. Prices are in U.S. dollars and may change at any time. Items are limited and may sell out. If an item is listed with an incorrect price or description, we may cancel the order and refund any payment.
• Taxes & shipping. Applicable taxes and shipping charges are shown at checkout. We currently ship within the United States. Delivery estimates are not guaranteed.
• Returns & exchanges. Unworn, unwashed items in original condition with tags attached may be returned or exchanged within 30 days of delivery, unless marked final sale. Email hello@sweetsny.com with your order number to start a return. Refunds go back to the original payment method.
• Damaged or wrong items. Contact us within 14 days of delivery and we’ll make it right.

Emails & messages

If you join the Drop List, you agree to receive marketing emails from us; you can unsubscribe at any time. If you contact us, you agree that we may reply to you at the contact details you provide. Please don’t send us payment card numbers, government ID numbers or health information through the Site or by email.

Your submissions

If you send us feedback, ideas or other material, you give us permission to use it without restriction or payment to you. Please don’t send anything confidential. You’re responsible for anything you submit and confirm you have the right to share it.

Intellectual property

The Sweet's name, the cloud-lettered Sweet's logo, the S mark, and the Site’s artwork, photography, text, design and code are owned by or licensed to NYsweets LLC and are protected by trademark, copyright and other laws. We grant you a limited, personal, non-commercial, revocable license to view the Site. You may not copy, modify, distribute or use our trademarks or content without our written permission. Members of the press can request brand assets at press@sweetsny.com.

Acceptable use

When using the Site, you agree not to:

• help anyone under 21 access the Site or obtain cannabis;
• use the Site in violation of any law or regulation;
• scrape, crawl or harvest data from the Site by automated means, except for search engine indexing;
• interfere with, probe or attempt to gain unauthorized access to the Site or its systems;
• upload or transmit malware, spam or anything harmful; or
• impersonate Sweet's or misrepresent an affiliation with us.

Third-party links & services

The Site links to websites and services we don’t control, including dispensaries, map and directions services, our checkout provider, social media and government agencies. We aren’t responsible for their content, products or practices, and your use of them is governed by their own terms.

Disclaimers

The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t guarantee that the Site will be uninterrupted, error-free or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, NYsweets LLC and its members, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site. Our total liability for any claim relating to the Site or these Terms will not exceed the greater of the amount you paid us for merchandise in the 12 months before the claim, or $100. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to defend, indemnify and hold harmless NYsweets LLC from any claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms or the law.

Governing law & disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve the issue informally within 30 days. Any dispute that isn’t resolved informally will be brought exclusively in the state or federal courts located in New York County, New York, and you and we consent to their jurisdiction.

Changes to the Site & these Terms

We may change, suspend or discontinue any part of the Site at any time. We may also update these Terms; when we do, we’ll change the “Last updated” date above. Continuing to use the Site after an update means you accept the revised Terms.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms; we may assign ours. These Terms and our Privacy Policy are the entire agreement between you and us about the Site.
